In the past few months, the EEOC issued the Pregnant Workers Fairness Act final regulations and several important case decisions under Title VII of the Pregnancy Discrimination Act. Attend this live virtual training with attorney Debra D’Agostino to find out what you need to know and do to comply with these two laws and their regulations, as well as the Providing Urgent Maternal Protections for Nursing Mothers Act.

You’ll explore reasonable accommodation as it applies to pregnant employees and get examples of potential accommodations the EEOC considers to be simple. You’ll also learn the scope of the Pregnancy Discrimination Act and how it applies today, including regarding fertility treatment, miscarriage, and abortion.

Guide your agency to avoid compliance missteps by learning how to:

  • Determine when a pregnant employee is entitled to reasonable accommodation under the PWFA through proper use of the interactive process
  • Identify and properly address pregnancy and childbirth-based harassment
  • Evaluate whether agency policies related to lactating employees comply with the PUMP Act and other relevant laws
  • Help your agency avoid successful claims of pregnancy and birth-related discrimination by knowing where other agencies erred
  • And more

The training includes interactive Q&A, so you can get Ms. D’Agostino’s expert guidance on the new situations and unfamiliar mandates you face under these laws.

With 41+ years of experience at the EEOC, Debra Finney will deliver a commonsense breakdown of what you need to know about the Guidance plus outline immediate steps to take so your agency stays compliant and promotes a harassment-free workplace.

You’ll leave equipped to address and prevent workplace harassment by learning strategies to:

  • Properly process “cross-bases issues” consistent with the EEOC’s Enforcement Guidance
  • Interpret the broad protections for LGBTQ+ workers and apply them to agency policies and practices
  • Determine if religious discussion should be allowed or if it creates a hostile work environment
  • Identify conduct in the virtual environment that can create a claim of workplace harassment

Recent MSPB cases highlight the importance of the deciding official’s role in making — or breaking — an agency’s adverse action on appeal. In this live virtual training, renowned federal expert Robert Erbe will review the MSPB’s latest cases involving decision letters, alerting you to mistakes made by deciding officials and providing best practices your agency can use to avoid those errors.

You’ll learn the importance of the precise wording of decision letters and why certain terms should and should not be used, so your agency can avoid language that raises instant red flags. You’ll also discover why and how to work with the deciding official to ensure that all Douglas factors are properly considered.

Take a more proactive approach in preventing mistakes in decision letters and hearings by gaining
Mr. Erbe’s best practices to:

  • Apply the MSPB’s most current rulings on penalty determinations to minimize risks of reversal
  • Incorporate your theory and theme of the case into the decision letter to support the reasonableness of the agency’s decision
  • Use the letter to “sell” the agency’s penalty decision, which can also be part of a compelling defense on appeal
  • Prepare the deciding official to be an effective witness during direct and cross examination at hearing and to avoid common “traps”
  • And more
